Intellectual Property Law

Often referred to as “Crown jewels”, intellectual property (IP) rights are a key asset for many companies. Patents, trademarks, copyrights and other IP rights enable companies to gain a competitive edge and determine their value for a large part. It is of the utmost importance for a company that its IP rights are exploited and enforced effectively. Adequate protection of IP rights is therefore key. A first summon or cease and desist letter may be followed by summary proceedings. Our experts have extensive experience in representing clients before various national courts and institutions.

We also advise our clients on the protection, strategic management and commercialisation of their IP rights, for example by drafting and assisting in negotiations regarding licence, technology transfer, distribution and research and development agreements. Our IP litigation experience gives us a good insight into the potential risks to be covered in a contract.

The topics we deal with include:

  • Brand and trade name protection;
  • Royalties;
  • Patents and copyright;
  • Trade marks, designs and advertising;
  • Database rights;
  • Drafting agreements relating to the transfer of intellectual property rights;
  • Licensing agreements regarding the use of intellectual property rights;
  • IT litigation including Infringement and summary proceedings;
  • IP enforcement
  • Reimbursements of costs pursuant to Article 1019h DCCP;

We advise, negotiate, litigate and make or assess agreements in the field of intellectual property law. If you are dealing with an IP-related topic, we recommend that you contact us as soon as possible as time is of the essence in IP law. Did you receive a summons letter stating that you are infringing a third party's intellectual property rights?  Or has someone wrongly used your intellectual property rights? Then call us.
